What is a CCJ and how does it affect me?

A County Court Judgement (CCJ) is a court order that says you owe money to a creditor. It appears on your credit file for 6 years and makes it very difficult to get credit, mortgages, or even some jobs. A CCJ can also lead to bailiff action if you do not pay. Getting help early gives you more options.

How can I get a CCJ removed from my credit file?

There are two main ways to remove a CCJ from your credit file. First, if you pay the full amount within one month of the judgement, you can apply to have it removed (set aside). Second, if you were not properly served the court papers or have a valid defence, you may be able to apply to set aside the CCJ. Otherwise, the CCJ stays for 6 years but is marked as satisfied if you pay it.

What happens if I ignore a CCJ?

Ignoring a CCJ will not make it go away. The creditor can take further action including sending bailiffs to your home, applying for an attachment of earnings (money taken from your wages), or charging order on your property. Interest may also be added to what you owe. It is always better to deal with a CCJ than ignore it.

Can I set aside a CCJ?

You may be able to apply to set aside a CCJ if you did not receive the original court papers, you have a valid defence against the claim, or you paid the debt in full within one month. Setting aside a CCJ cancels it as if it never happened. You will need to apply to the court and may need to pay a fee.

How long does a CCJ stay on my credit file?

A CCJ stays on your credit file for 6 years from the date of the judgement. If you pay the full amount within one month, you can apply to have it removed completely. If you pay after one month but within 6 years, it will be marked as satisfied but will still show on your file for the full 6 years.

Can bailiffs be sent for a CCJ?

Yes, if you do not pay a CCJ or keep to a payment arrangement, the creditor can apply to the court to send bailiffs (enforcement agents) to collect the debt. Bailiffs can visit your home and take goods to sell. Getting debt advice before bailiffs are involved gives you more options.

Can I include a CCJ in an IVA?

Yes, CCJ debt can usually be included in an Individual Voluntary Arrangement (IVA). An IVA is a legally binding 60 month plan where your debts and interest are frozen, and creditors cannot contact you. Once you are in an IVA, creditors must stop all enforcement action. The CCJ will still show on your credit file, but remaining debt may be written off at the end of the 60 months.

What is a CCJ satisfaction certificate?

When you pay off a CCJ in full, you can apply to the court for a certificate of satisfaction. This costs £15 and proves the debt has been paid. The court will update the Register of Judgments to show the CCJ as satisfied. This is important as it shows future creditors you have paid what you owed.
